DA Rourke clears officers in June shooting that left one man injured

GREELEY, Colo. (Weld County D.A.) – On Friday, September 17, Weld District Attorney Michael Rourke issued a letter and report to Greeley Police Chief Adam Turk in regard to the officer involved shooting of Randy Eberhardt on June 14, 2021.
The 19th Judicial District Critical Incident Response Team (CIRT) conducted the investigation which was provided to the District Attorney’s Office.
Based on the thorough CIRT investigation, DA Rourke has determined four officers were legally justified in discharging their firearms at Eberhardt during the incident.
Because there is a pending prosecution, the full letter and report will not be released at this time.
Eberhardt is charged with:
COUNT 1: ASSAULT IN THE FIRST DEGREE
COUNT 2: ASSAULT IN THE FIRST DEGREE
COUNT 3: ASSAULT IN THE FIRST DEGREE
COUNT 4: ASSAULT IN THE FIRST DEGREE
COUNT 5: ASSAULT IN THE FIRST DEGREE
COUNT 6: ASSAULT IN THE FIRST DEGREE
COUNT 7: ASSAULT IN THE FIRST DEGREE
COUNT 8: ASSAULT IN THE FIRST DEGREE
COUNT 9: FIRST DEGREE BURGLARY
COUNT 10: ASSAULT IN THE SECOND DEGREE
COUNT 11: ASSAULT IN THE THIRD DEGREE
COUNT 12: ASSAULT IN THE THIRD DEGREE
A status hearing has been scheduled for October 29 at 10:30 a.m. in Division 12.
